Terms of Service

These terms set out the basic rules for the provision of IT services, web development, and infrastructure management. Since I am not a commercial entity, but an individual performing occasional activities, these terms are written simply, transparently, and fairly.

1. Legal Status of the Provider

Services are provided by an individual (Ondřej Novotný) within the framework of occasional activities under § 10 of Act No. 586/1992 Coll., on Income Taxes (Czech Republic). I do not hold a trade license and do not act as a business entity (freelancer/sole trader).

2. Limitation of Liability

I provide services with the highest professional care; however, I am not liable for outages, operational restrictions, malfunctions, or potential data loss resulting from:

  • Technical failures, planned or unplanned maintenance, or widespread outages on the side of external infrastructure services (e.g., Cloudflare, Web3Forms, hosting providers).
  • Force majeure, cyber attacks (including DDoS), or unauthorized interference by persons to whom the client provided access credentials.
  • Domain expiration or project deletion due to the client's failure to pay fees to third parties.
  • Changes to the configuration or source code made by the client or a third party without my prior knowledge.

Furthermore, I am not liable for any indirect damages, loss of profit, or subsequent financial losses caused by the temporary technical unavailability of the created solutions.

3. Client's (Customer's) Responsibility

The client is fully responsible for the factual, legal, copyright, and legislative integrity of all materials, texts, images, and documents they provide to me for the purpose of publication on the website.

4. Copyright and Licensing

The source code of the web presentations is my authorial work. Upon full payment of the agreed project fee, I grant the client an exclusive and time-unlimited license to use the work for their own needs. However, I reserve the right to reuse general, non-thematic, and universal parts of the source code (software libraries and components) for my other projects.

5. Final Provisions

The specific parameters of cooperation (price, deadlines, scope of work) are always negotiated individually via a written agreement before work begins. These general terms form their supplementary framework.
